The terms and conditions below apply to all orders placed using our website www.westcountrycheese.co.uk and any orders placed with us by telephone and form the basis on which you can visit us and our website. Please read them carefully as they contain important information

General Terms and Conditions

This site is owned and operated by The West Country Cheese Co, based in Devon and registered in England. Ownership of rights

All rights, including copyright and photography, in this website are owned by or licensed to The West Country Cheese Co. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited. You may not modify, distribute or repost anything on this website for any purpose

Accuracy of content

We have taken care in the preparation of the content of this website, that prices quoted are correct at the time of publishing and that all goods have been described accurately. At times, some cheeses are substituted for an alternative version, so please do read packaging prior to eating if any particular allergies.  All prices shown are not inclusive of delivery fees unless otherwise stated. The reproduction of colours is as accurate as the photographic process will allow.

Availability

All products listed on the web site are subject to availability. Some of our cheeses, for example, are either seasonal or come from small producers, and on rare occasions may not be available. It happens. We’re always happy to suggest a good alternative or substitute something we consider equally as good or better. If we are waiting to stock up on a cheese you require or its unavailable, we will advise you and you can opt for the alternative or reconfirm delivery timings once the item is available or if not suitable, a full refund will be given if you have already paid for the goods.

If your order is a  gift  we will send it as quickly as possible and therefore, in the rare event of any specific cheese stock shortage we may substitute a cheese or product with a like for like replacement so as not to delay the shipment. For any weddings, birthdays or other events which are ‘booked in’ with a specific date from us then we will always attempt to contact you to discuss a replacement. It is your responsibility to supply correct email and telephone contact details.

Cheese Weights

We do our best to cut the cheese accurately. However, with our staff being human and this being all done by hand, occasionally our weight may not be totally precise. What we do is cut to the nearest weight possible and where we are slightly under on one cheese we will make up for it on the next, so the overall amount of cheese we promise will be reached. Again, whole cheeses are approximate in weight as these are handmade, so if listed as 500g this may be slightly over or slightly under

Pricing

Prices quoted for cheese are by weight or otherwise by unit and this is specified next to each item. We reserve the right to alter any prices or specifications at any time without notice. If you have placed your order and prices are amended prior to despatch, you will be notified and have the option of cancelling with a full refund

Acknowledgement of your order, order process and registration

You may register an account with us when purchasing products from our website. It is your responsibility to prevent unauthorised access to and use of your account details. Please ensure that you maintain the confidentiality of your username and password, and take all necessary precautions to prevent unauthorised access to and use of your account. Please notify us immediately if you believe that your account is being used in an unauthorised manner or if you believe that your username/password has become known to someone else

Please ensure that the details you provide when registering an account with us are correct, complete and up to date. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use

You need to notify us immediately of any changes to these details (Including change of e-mail or postal address. Please ensure you inform us of these details by email on: enquiry@westcountrycheese.co.uk as well as updating your account details

We reserve the right to terminate accounts, remove or edit content, or cancel orders at our discretion. If we do cancel an order, it will be without charge to you. If we have sent an order to an incorrect address and you had not advised us of a change of address by e-mail, then goods will not be resent to you and you will not be refunded

To enable us to process your order, you will need to provide us with your e-mail address. We will confirm receipt of your order by sending you an email containing the details of your order. At this point, we accept your order and the contract is formed

Please note that it is your responsibility to check that all information listed in the confirmation e-mail is correct. If anything is inaccurate, please notify us immediately by e-mail, or by calling us on 01271 379944. We will not be able to reimburse the value of any goods which have perished or have been damaged or incorrectly sent because of your failure to notify us of inaccurate information being listed

Payment

Payment or part payment received when you place an order on our website or by calling us, represents an offer on your part to purchase the goods. When you order, you are providing details which are true, accurate, up to date and complete in all respects, including any credit or debit card details provided to us, these must be correct and your own

We offer secure online payment through Paypal which accepts all major debit and credit cards.

A Paypal account is not necessary for payment

Payment by card is available along with flexible payment terms for orders over £100, please call us on: 01271 379944, we can take your order and process your payment through our card machine.  BACS payment is also acceptable, you can email your order and make your payment directly into our bank, our account details are: Lloyds Bank account no: 00822909, sort code: 30-93-14

Please note that we cannot guarantee the security of any data sent by email. Please DO NOT send us your card details or payment information via email

Refunds/Cancellations

Should you wish to cancel your order, please contact us on: 01271 379944. Provided your cancellation request is received before your items have been despatched, we will cancel your order and refund you. We have implemented a £6 admin charge to deal with any refund requests.  We aim to do this within 48 hours of being advised.

Should your order include our handmade pies and they have been baked, then unfortunately we cannot refund you for this part of your order.   If your order has already been despatched then it is  not possible to refund you at this late point.

We may make a deduction from your refund for any loss in the value of the goods we have already ordered in ready to supply to you

If your order hasn't arrived in time for an event and you haven't requested it two days prior to your event (excluding bank holidays) then it will not be possible to refund you 

CANCELLATION BY US

We reserve the right not to process your order if:

We have insufficient stock to deliver the goods

We do not deliver to your area

Payment has not been received

If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 14 days

Returns

We love our customers and your cheese happiness is pretty important to us. We make every effort to get your cheese to you in good condition. However, if you do find that your cheese is not in a satisfactory condition or has been damaged in transit, please ensure you notify us within 24 hours of receipt of goods.

We may also need you to return the cheese back to us and supply photographic evidence. Returns are only accepted, once despatched, if the goods are damaged.

Please note we cannot be held responsible for any parcels not being delivered if incorrect delivery information is given. It is at your own risk if a package is left, again, we cannot be held responsible for packages we do leave without obtaining a signature.  We cannot be held responsible if you haven't allowed 48 hours (working week) for your order to arrive, please note this does not include Bank Holidays. 

General

We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions. We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control

Furthermore, we will not be responsible to your or any third party for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption

Our liability to you under these terms and conditions will not exceed the total price charged for the items purchased

None of the above terms affect your statutory rights if goods are damaged or incorrectly supplied by us nor does it affect your rights under the Consumer Protection Regulations

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible

Risk and Ownership

We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment because of using this website

The West Country Cheese Co website may occasionally include links to third party sites. You acknowledge and agree that we will not be responsible for the availability of such third-party sites and will not be responsible or liable for any content or services available from such third-party sites.
